Part 1: rules for everyone

Who we are

TYB Labs is a brand of Lanier Web Development, based in Georgia, United States. Contact: daniel@tyb.ai. In these terms, "we" and "us" mean TYB Labs, and "you" means the person using one of our products. Write to us about anything at all. A real person reads it.

The services

We make three products: TYB (Train Your Brain), PollyStop and PollyClass. Part 1 covers all three. Each product also has its own schedule below, and where a schedule says something different, the schedule wins for that product.

Your account

You need an account for most of what we make. Give us accurate details, keep your password to yourself, and tell us if someone else gets into your account. What happens through your account is your responsibility. You must be 18 or over to open and pay for an account. Accounts for children are created and controlled by a parent, as Schedule A explains.

Acceptable use

Use our products to learn and to teach. Do not break the law with them, do not try to break into them, do not scrape them, and do not resell access. Do not upload anything you have no right to upload. We can suspend an account that does any of this, and we will tell you why.

Our content and yours

You own what you write, say and upload. To run the service we need your permission to store it, show it back to you, and send it to the processors named in our privacy policies. That permission ends when you delete the content or close your account. Everything else, including our software, lessons, stories and artwork, stays ours.

AI content is not advice

Our products use AI, and AI gets things wrong. Treat what it says as a study aid, not as fact, and never as medical, legal, financial or safety advice. Check anything that matters. Parents and tutors should stay involved in what a learner is being told.

Availability

The products are provided as is. We add features, change features and remove features. We may take a product down for maintenance, or stop offering it altogether. We do not promise that a particular feature will keep working, or that anything will be free of bugs.

Prices

Prices, plans and free tiers can change at any time. A free plan is never guaranteed. We tell existing paying customers before a price change affects them. Payments are handled by our payment provider, which keeps your card details rather than us.

Ending it

You can stop using a product and close your account whenever you like. Ask us at daniel@tyb.ai and we will delete your data. We can close an account that breaks these terms.

Liability

If something goes wrong, we are liable to you for at most what you paid us in the twelve months before the problem, or 50 euros if you paid us nothing. We are not liable for lost profits, lost data or indirect losses. Nothing here limits liability that the law does not allow us to limit.

Governing law and disputes

These terms are governed by the laws of the State of Georgia, United States. Any dispute goes to the courts there. Please email us first. Most things are a misunderstanding and we would rather fix it than argue about it. If you are a consumer, the consumer rights of your own country still apply.

Changes to these terms

When we change these terms we change the date at the top of this page, and we email account holders if the change is a big one. If you keep using the product after a change, you accept it.

Schedule A: TYB (Train Your Brain)

TYB is an AI tutor for children, and a parent is always in charge of it. It runs on trainyourbrain.ai and in the TYB mobile apps.

A parent or guardian creates the family account and creates each child account inside it. The parent agrees to these terms on the child's behalf. A child cannot sign up alone.

The Children's Online Privacy Protection Act (COPPA) requires parental consent before an online service knowingly collects personal information from a child under 13. We ask for that consent before a child account exists, and we comply with COPPA and with the GDPR. We do not use children's data to train AI models. The detail is in the TYB privacy policy.

A parent can read their child's chats, change what the tutor knows about the child, and delete the child account and its history at any time. If the app will not do it, email us and we will.

TYB's tutoring is AI-generated. Like any tutor it can be wrong or incomplete. It helps with homework, it does not replace school or a parent. Please report anything that looks wrong so we can fix it.

By signing up you agree to receive email about the account, including the weekly summary we send parents. You can change what you get in your account settings, and every email carries an unsubscribe link.

Schedule B: PollyStop

PollyStop is a language app for people aged 13 and up. It is not for children under 13. It runs on pollystop.com and in the PollyStop mobile apps, and its privacy policy is at pollystop.com/privacy.

Speaking practice. Your device turns your speech into text using Apple's or Google's built-in speech recognition. We receive the text, not the audio. We never store recordings of your voice, we do not use your speech to train models, and we do not sell it.

Avatar photo. Uploading one is optional. If you do, Google's image model draws the cartoon version we display, and the raw photo is never published. Pick a preset animal instead and you upload nothing.

Social features. Leaderboards, following and cheering are opt in. They show other learners your username, first name, avatar, the languages you are learning and your stats, and nothing beyond what the privacy policy lists.

Focus mode. If you use PollyStop to block distracting apps, the list of blocked apps stays on your device. You control it and you can turn it off. It is a tool for your own attention, not something we enforce on you.

AI feedback is premium. Feedback on your speaking and writing belongs to the paid plan. On a free account it may be missing, capped for the day, or limited in some other way, and we can change those limits.

Schedule C: PollyClass

PollyClass is for language tutors and small schools. It runs on pollyclass.com. Its tutor-facing terms and privacy policy live there, at pollyclass.com/terms and pollyclass.com/privacy.

You must have the right to add a student before you add them, and the right to send them a practice link. If a student is under 13, get the parent's agreement first. What you type into a student's record is your responsibility.

Your notes about a student are yours and are private to you. We do not show them to the student, we do not sell them, and we do not turn tutor notes or learner histories into templates or training data for anyone.

A learner's practice belongs to the learner. Practice done as a guest on an invite link is kept for 14 days and then deleted. If the learner connects a PollyStop account, the practice moves with them and stays theirs.

PollyClass does not replace your booking or payment platform, and it does not manage your relationship with a marketplace you teach on. Their rules are yours to follow, including any rule about where you may send a student.

The first ten founding tutors get PollyClass free while we build it together, for as long as they keep teaching with it and telling us what is wrong. After that, a free plan covers five active students and paid plans cover more.

Prices can change at any time, a free plan is never guaranteed, and we do not promise the service will always be available. We will say so plainly before anything changes for you.
